How the US Democratically-controlled Congress endeavors to establish a modern European Socialist Regulatory Welfare State will be addressed in a forthcoming law review article due to be released sometime during October 2008. It will address the relationship between the UN Law of the Sea Convention, the global environmental movement and US federal environmental laws that Congresses and Presidents past have tried to 'change' to reflect the UN/EU Precautionary Principle.

As Concerns the subject of today's blog, Eurobama's foray into Europe last month revealed the broader strategy of the Democratic Party's gameplan: Use greater ties with Europe to 'Change' US domestic environmental laws and policies, and with them, US private property right protections as guaranteed by the Bill of Rights accompanying the US Constitution. In other words, the Democrats wish greater domestic flexibility in exercising federal governmental 'police powers' to avoid 5th Amendment Takings Clause conditions so that they can create 'constructive trusts' to protect both federal and private lands, airways and waterways from 'objectionable' economic activity within the continental US. This climate change strategy subsumes the global and US environmental movements, and also feeds into the UN Law of the Sea Convention. The UNCLOS imposes obligations on countries party to the treaty to regulate 'land-based' sources of pollution, which comprises approximately 80% of all marine pollution.
